1. Definitions

The following terms have the following meanings:

“Candidate” a person listed on MissMolly to provide Childcare Services

“Child Care Services” private child care for children of any type including but not limited to babysitting and nanny work.

“Member” a User registered for the Miss Molly service in accordance with these Terms & Conditions

“MissMolly” The business of providing a database of Candidates in accordance with these Terms & Conditions. The business is provided by (E C Curwen for Babysitter-Directory and MissMolly) whose registered address is Mirefoot, Burneside, Kendal, Cumbria, LA8 9AB. ].

"You" & "User" are used to refer to all persons, individuals, Members, companies, partnerships or entities, using this website for any reason.

“Web Site” www.missmolly.co.uk www.missmolly.co.uk is owned, operated and made available by E C Curwen for “MissMolly” whose registered office is at Mirefoot, Burneside, Kendal, Cumbria, LA8 9AB.

MissMolly reserves the right to modify & revise these Terms & Conditions at any time. Each time you use MissMolly you should review these Terms & Conditions as by using MissMolly you are bound by the most current version.

2. Description of the MissMolly Service 

2.1 MissMolly is a database where Users are able to search for a childcare professional. MissMolly does not warrant that any information posted is true or current. It is the sole responsibility of the User to make any enquiries, CRB checks or references it feels necessary to satisfy themselves as to the exact type and nature of the services that are being offered.
2.2 These details are available to Members. All contact details provided by Members registering with MissMolly will be available to Members and to Candidates.
2.3 MissMolly is not an agency. MissMolly works as a search tool for Users seeking Childcare Services to locate and contact child carers willing to work in the areas where the User requires childcare.

3. Use of the MissMolly website

3.1 The MISSMOLLY website may only be used for lawful purposes by Users seeking childcare services.
3.2 MISSMOLLY prohibits the use of its website for the following and Users agree not to use, or allow any person, party or individual under their control use MISSMOLLY for the following:
a) False, incorrect or incomplete postings of biographical information or information which is inaccurate or not your own;
b) Searching the MISSMOLLY nanny and babysitter database for any purpose other than to find Childcare Services;
c) for any unlawful purpose, or any purpose that is likely to bring MissMolly into disrepute or cause any part of MissMolly embarrassment;
d) to send any message that is offensive, abusive, indecent, obscene or menacing;
e) in any way that would be reasonably expected to cause annoyance, inconvenience or needless anxiety;
f) as source targeting material or contact date for any kind of telemarketing, direct marketing, viral or any other electronic marketing activity on your own behalf or for the benefit of another party;
g) to distribute display or transmit information or content which is of a commercial nature;
h) to access data not intended for a User, you may not access or log into a server or account which you have no authorisation to access;
i) to test, scan or probe the vulnerability of the MissMolly networks and systems or breach security
j) attempting to interfere with a Users’ ability to access or use the Website including but not limited to “spamming; sending a virus, “flooding”; “crashing”; “mail bombing”.

4. Copyright and Database Right

MISSMOLLY permits the use & download of a copy of the material provided on the website for your personal use only. The material provided on MissMolly is not for commercial use. All content provided by and on the MissMolly website & all other websites under MissMolly’s control are protected under United Kingdom copyright and database laws. This includes the database, any list, graphics, software, text, images, logos, icons, button icons and all other website content. All the said content is the exclusive property of MissMolly. Unauthorised use of MissMolly’s website content may violate copyright, database, laws. You are in no way permitted to modify or sell the MissMolly website's content. If you use or copy any part or all of the MissMolly websites content, you must retain all copyright notices which were shown on the original website.

MissMolly takes active measures to ensure that no unauthorised breach of its Intellectual Property rights is committed.

5. Membership of MissMolly

5.1 To gain full access to the service provided by MissMolly, Users need to follow subscription procedures. Users will also be required to select a membership criterion. Memberships must be paid in advance, full access to the website details will only be made possible on receipt of payment. Payment may be made using the online payment system provided on the Website.
5.2 Payment is made for one of several Membership options. It is the Users’ sole discretion which Membership selection to make.
5.3 Costs of the Membership criteria are available on the MissMolly website.
5.4 Once your Membership has expired you will no longer have full access to the Website. Access will be granted again once the Membership fee has been paid.
5.5 The prices charged for each Membership selection are the prices in force at the date and time of your subscription. MissMolly may alter and change the price of each Membership selection. MissMolly tries to ensure prices are correct and accurate at all times but does not guarantee this. The User has the right to cancel a Membership order at the time of subscription if the price of the membership selection quoted differs from the actual price. Prices are exclusive of VAT and other applicable taxes. These taxes and VAT charges must be paid in addition by you.
5.6 Once MissMolly has received payment from you for your selected subscription MissMolly will confirm this by email. MissMolly reserves the right to refuse a membership subscription made by you.
5.7 The User undertakes to provide true and correct details for the purpose of subscribing to the MissMolly service and pays a membership fee to gain full access to the service. The User undertakes to provide true and correct credit, debit or any other electronic switch details, the User undertakes that the payment method and details used are your own and that sufficient credit or funds are available to you to use at the time of a MissMolly membership purchase. These credit facilities and funds must be sufficient to cover the cost of your selected membership purchase.

6. Liability

6.1 MissMolly shall not be liable under any circumstances for any loss, damage, expense, or compensation suffered or incurred by a User either directly or indirectly arising from or in any way connected with MissMolly.
6.2 MissMolly does not guarantee the suitability of any Candidate introduced to the User. The decision to employ a Candidate is the sole responsibility of the User. The User must satisfy themselves as to the suitability of the Candidate and it is the responsibility of a User take up any references provided by the Candidate to it before employing a Candidate. MissMolly does not accept any liability for any inconvenience, damage or loss arising whether caused directly or indirectly from any act or omission of a Candidate introduced to the User by MissMolly.
6.3 MissMolly offers no warranty for a nanny, babysitter or other childcare professional’s character, honesty, reliability, suitability or capacity. Because of the nature of the Internet User authentication is difficult, therefore MissMolly does not guarantee or confirm that any User is who they claim to be.
6.4 MissMolly is not responsible for the User and Candidates contract of employment. These are to be arranged between the User and Candidate. MissMolly provides an example contract of employment only as a guide for the User. MissMolly cannot and is not held responsible for user to user communications. By using the MissMolly website you agree to release MissMolly, our agents and employees, from claims, damages and demands of any kind arising out of or in any way connected with any dispute you the User may have with any other User Member or Candidate.

7. Disclaimer of warranties 

7.1 MissMolly does not guarantee the reliability or accuracy of content provided on the site. Nor does MissMolly guarantee that the service will be without fault or error. MissMolly does not guarantee that a User’s specific requirements will be met by the websites service.

8. General

8.1 The User, is responsible for the password and any information provided by you to the website. Any and all uses of your registration with the MissMolly website are your sole responsibility. Should there be any unlawful or unauthorized use of your password or registration you agree to notify MissMolly immediately.

9. Jurisdiction

These Terms & Conditions shall be construed in accordance with and governed by the laws of England and the parties submit to the exclusive jurisdiction of the Courts of England. Although the MissMolly website can be accessed from other places in the world which may have different laws from those of England, by using the MissMolly website you are agreeing to submit to the non-exclusive jurisdiction of the English Courts.

Users of MissMolly accessing the website from places outside England acknowledge that they do so voluntarily and are responsible for complying with local laws.
